Copyright and DMCA Policy

Only submit photos, videos, music and text that you created or have permission to use. Newspaper photographs are typically owned by the publication, and professional portraits or studio photographs are often owned by the photographer and not the subject or the subject’s family. If you're unsure, contact the photographer or rights holder for permission before uploading.

If you believe content on LifeCelebrations.com infringes your copyright, send a written notice to our designated agent that includes all of the following:

• Your physical or electronic signature, or that of a person authorized to act on your behalf
• Identification of the copyrighted work you claim has been infringed
• Identification of the material you claim is infringing and information sufficient for us to locate it, such as the full URL of the memorial page
• Your name, address, telephone number and email address
• A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent or the law
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
• A brief explanation of why you believe the material infringes on a copyright.

Please note: under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees. Do not file a notice unless you are the rights holder or authorized to act for one.

Upon receipt of a notice that complies with the requirements above, we will review it promptly and take appropriate action, which may include removing or disabling access to the identified material, typically within 10 business days. If we remove your content in response to a notice, we will make a reasonable effort to notify you and provide a copy of the notice (including the complainant's contact information) so that you can evaluate whether to submit a counter-notification as described below. We may also, in appropriate circumstances, remove content identified in a valid notice without regard to the 10-business-day timeframe where earlier removal is warranted.

If we removed material you posted and you believe the removal was a mistake or the material was misidentified, you may file a counter-notification with our designated agent by email to dmca@lifecelebrations.com or by mail to New SV Media Inc., 7455 Monterey Ave., Gilroy, CA 95020. A counter-notification must include:

• Your physical or electronic signature
• Identification of the removed material and the location where it appeared before removal
• A statement, made under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification
• Your name, address and telephone number
• A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, the Northern District of California) and that you will accept service of process from the person who filed the original infringement notice or their agent

If we receive a valid counter-notification, we will forward it to the person who filed the original notice. Unless that person notifies us within 10 business days that they have filed a court action, we may restore the material within 10 to 14 business days after receiving your counter-notification.

We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyrights.
